In aggravated assault, 3rd time is no charm

Phoenix – After standing trial three times for hitting a Phoenix police officer with a two-by-four, a Glendale man was convicted of aggravated assault in Maricopa County Superior Court Monday.

Luciano Arriaga, 38 already had one conviction for the same crime overturned on appeal because of a judge’s error. His first trial ended in a hung jury.

The charge stemmed from an altercation with a Phoenix police officer in 2002.

The officer saw Arriaga roll through a stop sign, and when Arriaga got out of his car to walk into a body shop, the officer followed him.

During the ensuing tussle, Arriaga grabbed a two-by-four and struck the officer. Arriaga was charged with resisting arrest and aggravated assault.

In September 2002, a jury found him guilty of resisting arrest, but deadlocked on the assault charge. That conviction was overturned in August 2004.

Dude, I hate to tell you, but you can't call him an "innocent person going to jail" without citing some sources that prove he isn't guilty.

I read the PhoenixNewTimes Story and I want to correct the comment "Luciano grabbed a 2x4 and hit the cop Warren B. Poole. Luciano Arriaga Jr. was on the ground tummy down tipping the scales at 140. Warren B. Poole, over 200 pounds and fully loaded with every imaginable weapon cops carry was on top of Louie at all times. He had Louie in a knee hold down on the ground at all times. Louie was maced twice and was almost unconscience at that point when all of a sudden fearing death he happened to see a stick on the ground. It was not a 2x4 as the prosecutor stated. Of course prosecutors lie!!! Don't you think.
It was almost impossible for Louie to pick up an swing that stick over his head while tummy down with a 200 pound cop on top of him. I think the cop hurt himself during his "Fog of War" moment with the stick Louie managed to life a few inches off the ground. The cop was all excited and in a panic knowing he stopped and attacked someone with zero story to back him self up with to his authorites so he lied and made one up as the papers say. The
cop had so many different versions of the story to tell! They knew he commited perjury and the Judges allow this to happen. Louie had the right to defend himself in court and to present evidence to defend him and his attorneys were not allowed to present all the evidence. So all I want to say is the people have the right to know the facts and know the truth.
Heres one for the truth and Justice. Louie I hope Justice prevails in your case. I happen to know he is in jail as I write this. Yes! The ill informed Jury found Louie "Guilty" again??

Mr. Hey Dude! When this happens to you I wonder what kind of song you will be singing. You will wish you had supporters like us to defend you.
First of all the cop lied about the whole stop. He had several versions of the story he didn't know what to come up with next to defend his lies. Louie's Attornys had a great deal of source's that proved Louie was innocent, and of course the city prosecutor's and Judge's did not allow these source's in court? I call this persecution at its best.
The City wanted to put Louie away behind a locked cell so they did not have to pay the liability the corrupt cop subjected the city to.First of all we know this cop is a drunk with a capital "D" you can find him at any given evening at the local strip joints in Phx he frequents often. This cop has priors in his files that the city is covering up. This cop was feeling the pain of having his beloved job taken away because of bad behavior.That is about the time he ran into Louie on the street. Louie was on his way to have breakfast with his friend that Feb morning of Feb 6, 2002.
The charge of running a stop sign was thrown out of court because a witness stated Louie did not run it. The cop could not even see the stop sign he admitted in court during the trials?
So why did he stop Louie?? Louie did not commit a crime, is not a druggie, is not a drunk, doesn't even smoke. His papers were all in order when asked of them by the cop.
Why did this cop decide to attack Louie is such a manner??
If someone hit you like that what would you do not only did he stomp on Louie with his 200 plus body but he maced him twice? He was about to dragg Louie to concrete so he could slam his head against it. Up to that time Louie seen the stick he was slamming Louie's head against dirt. He applied the carotoid hold on him twice??
Why? Why? Why all the violence?
This cop went "WACKO" He yelled in Louie's ear" I AM A OFFICER OF THE LAW AND YOU ARE GOING TO DO AS I SAY" So tell me Mr. know it all "WHAT WOULD YOU HAVE DONE IF THIS HAPPENED TO YOU! If it was me I would have done what Louie did "NO ONE HAS THE RIGHT TO DO ALL THE ABOVE WITHOUT REASON ANY REASON FOR THAT MATTER" We don't live in a third world county!!
